Terms and Conditions

This is an enrolment form under which you and/or your student agree to become a member of Universal Dance Company. When you complete this form, you are entering into a legally binding agreement. 

This agreement (your enrolment) is made of the terms contained in this form including enrolment details (Details), the enrolment form (Form), Payment and General Terms & Conditions (Terms) plus any special conditions.

This agreement sets out your rights and the obligations you have to comply with. You promise to tell us if at any time you believe you may not be able to comply with your obligations under this agreement including the payment of fees, so we can discuss options with you. 

What is set out in this agreement overrides any statements made by you or us before you entered the agreement. Accordingly, you should now read through the terms and conditions carefully to make sure that it fully reflects your expectations and ask us or seek advice if you are unsure whether any particular statements that you have relied upon are part of this agreement.

Payment Terms & Conditions

Your Membership with Universal is an ongoing, periodic agreement that will continue until you or we terminate it in a way described in the Terms of Enrolment. Direct Debit is the method of payment via Ezidebit. Monthly fees will continue to be debited from your account until you or Universal cancels the Agreement. If you terminate the Agreement or stop the automatic debit arrangement in a manner not described in this Agreement, then you may be liable for damages for breach of contract. 

If your automatic direct debit reverses or is returned to us by your financial institution, we will contact you via email about rectifying the missed payment. You will be responsible for Ezidebit Dishonour fee of $21.90 should a payment be unsuccessful. If the debit remains outstanding, Universal will follow our missed payment protocol which will require you to catch up your missed payment within 7 days. If you fail to pay Universal, the fees required by the due date, we are entitled to refuse your enrolled student/s entry to Universal and pause your enrollment until fees are fully rectified. If unpaid fees remain outstanding after attempts by us to rectify the arrears, your membership may be forwarded to a collection agency for further action; where you will be responsible for all costs incurred by Universal for monies owed under this agreement including recovery agent costs, repossession costs, location search costs, process server costs and solicitor costs.

Packages are holistic and cannot be broken into bits and pieces. All inclusions apply (where applicable), whether you take advantage of them or not. If you terminate your agreement, or if Universal cancels the agreement, you agree to forfeit all inclusions that have not been accessed thus far in the calendar year (e.g. If you terminate the agreement in Term 3, you forfeit your Showcase costumes, Professionally Filmed copy of the Showcase and Showcase tickets). 

Families who have 2 or more students enrolled will receive a 5% discount off the sibling(s) package fees only or whichever equates to the lesser amount. This is the maximum discount, as it applies to ALL areas of the package – not just the tuition.

Your membership may be terminated under the following conditions: 

  1. Permanent Sickness or Physical Incapacity 

  • Universal requires a written cancellation request advising the nature of the illness or physical incapacity, outlining specifically how this prevents your student(s) from participating in classes at Universal.

  • Universal also requires a Medical Certificate stating that your student(s) is/are not fit for classes because of their permanent illness or physical incapacity.

  • Universal may agree to cancel the membership upon payment of a cancellation fee of $75.

2. Cancellation for any other reason 

  • Universal requires a written cancellation request advising a plausible reason for ending the agreement.

  • After negotiations, if a solution to continue the membership cannot be settled, the member may terminate this agreement. There will be a period of notice (30 days) from the date of the cancellation request to the date of termination; during which and payments that fall due must be paid in full. Termination of this agreement will also terminate the direct debit request authority.

3. Termination by Universal

  • Universal reserves the right to terminate this membership agreement in accordance with the following conditions 

  • Failure to abide by the Terms of Enrolment, the Code of Conduct or any other items stated in this Agreement Action upon a complaint from either another member or employee (or contractor) of Universal.

Force Majeure Clause

In the event that Universal Dance Company is required to close or suspend classes due to circumstances beyond our control, including but not limited to extreme weather events, natural disasters, pandemics (including COVID-19), government-mandated restrictions, power outages, or any other unforeseen emergencies, no refunds or credits will be issued. The scheduling of any make-up classes or alternative arrangements will be at the sole discretion of the studio and subject to availability.

General Terms And Conditions

ABSENTEEISM

Please notify Universal via email if your student(s) are unable to attend class. 

Missed classes are non-refundable but 

  • Classes can be ‘made up’ by attending an alternative class; 

  • Must contact Universal in advance to arrange

  • Subject to availability – no guarantee if class is already at capacity

  • More than one day in a row away from class or inability to participate in class (e.g. injury) will require a medical certificate

Regular attendance is required to ensure your student(s) are making good progress 

Regular attendance is compulsory for students sitting their exams. 

END OF YEAR SHOWCASE

All students are expected to participate in the Universal annual showcase. 

  • Please inform Universal in writing, if your student(s) won’t be attending. 

2025 Annual Showcase will be held at QUT Gardens Theatre on 13th of December. 

  • Tech and Dress rehearsal – please see ‘Compulsory Dates’ and Annual Planner for more information 

  • Every student will be provided with a costume requirement list detailing the costume description, shoes, stockings, make-up and hair requirements for the photo day, dress rehearsal and Showcase. 

Parents/guardians will NOT be permitted back stage or in the dressing rooms during the showcase and dress rehearsal. 

  • Teacher/Parent helpers are assigned to each age group to ensure the smooth running of costume changes backstage. This enables parents/guardians to sit in the audience and watch their student(s) perform and enjoy the showcase. 

  • If you wish to volunteer as a helper, please let Universal Management know

ALL students must be present from the beginning to the end of the Showcase. 

FOOTWEAR

All dance shoes must only be worn on surfaces suitable for dance 

  • Please remove dance shoes (especially tap shoes) before leaving the premises

UNIFORMS

All students are required to wear the Universal branded uniform to their classes, with correct shoes and hair neatly tied back and secured off their face (except for ballet where a bun is required using a net and pins). Uniform order forms and shoe requirements are emailed to clients upon completion of enrolment.
